TERMS & CONDITIONS

Please go through the following Terms and Conditions that govern the relationship between you (client) and Naata Travel & Adventures Pvt. Limited (hereinafter referred as “The Company”), Registered Company Number 187902/74 075.  When receiving a booking along with a booking deposit from the client, it is understood that the client has read and understood the Booking Terms and Conditions.

Note:  While booking a trip, please understand that most of our trips are adventure trips and require certain level of flexibility. Although we make every effort to exactly follow the itinerary but it might not always be possible since we operate trips in remote parts and mountainous terrain. The day-to-day itinerary shown in the website or in any of our promotional materials should be taken as a guideline only.

To accommodate changes in travel plans due to Covid-19, we’re offering complimentary rescheduling options, allowing you to use your trip credits or deposit until the end of 2025 at no extra cost. Our usual rescheduling fee of USD 200 per person is being waived for pandemic-related alterations, providing flexibility for postponing your trip without financial penalty. To request rescheduling, please send written notice via email. However, if you’re rescheduling for reasons other than Covid-19, our standard terms and conditions will apply. It’s important to note that payments for canceled trips are non-refundable.

1. BOOKING A TRIP

A ‘trip’ refers to any product itinerary or activities that you buy with us including Trekking, Tours, Expeditions, and/or other adventure sports and tour programs.

A booking is accepted and becomes definite only from the date when the Company sends a confirmation invoice or email. It is at this point that a contract between the Company and the Client comes into existence.

Please note that the company would not be liable to any warranty, collateral agreement, prior agreement, description of services, or conditions, other than as expressed in the confirmation invoice or e-mail.

2. DEPOSIT REQUIREMENT:

a. Nepal Trips:

To secure your booking for Nepal Trips, a non-refundable deposit of 20% of the total trip cost is required. The remaining amount should be sent to us at least 2 weeks before your arrival or you can even bring Cash Dollars with you but should be paid on arrival.

Traveler’s Note: The non-refundable deposit should be sent to the Company or its Agent. The Company’s Tailor Made trips may require a higher deposit or full payment at the time of booking. If deposit is different from that outlined in this clause, you will be advised by the company at the time of booking.

b. India/Tibet/ Bhutan Trips:

To secure your bookings for India/ Tibet and Bhutan Trips, a non-refundable deposit of 25% of the total trip cost along with due airfares (if client wants the company to arrange it) is required. If you’re booking 21 days or less prior to departure, full payment is required.

3. PAYMENT PROCEDURES:

Payment can be made either by Bank Transfer or by Credit Card (Visa or Master Card).

Credit Card Payment

If you want to make payment by Credit Card, you will need to fill out the Credit Card Payment Form. Please send us the filled out form via email. Your Credit Card is handled and charged by Alpine Credit Card Services on behalf of Naata Trek and Tours Pvt Ltd. Instruction of payments is provided in the Credit Card Payment Form. Please note that there is additional service charge of 3.75% to the total amount, so while making payment, please add 3.75% surcharge of the cost you are paying by Credit Card. (Please confirm before making Credit Card Payment).

Note: Naata Trek and Tours shall not be held responsible for not operating the trip i.e. holding back client if the final payment didn’t arrive timely

4. CANCELLATION:

a. Cancellation by Client:

Any cancellation by a Client must be made in writing and acknowledged by the Company. For the cancellation of the booked trip due to any reasons, following cancellation charges will apply:

a. One month before the trip:     30% of the total trip cost
b. 15 days before the trip:            50% of the total trip cost
c. 7 days before the trip:              75% of the total trip cost
d. Less than 7 days of the trip:   100% of the total trip cost
Please note that no refund will be entertained for those who leave the trip due sickness, injury or any other reason leaving the main group behind. No refund will be given for any unused service. The clients themselves need to pay for their meals and accommodation and any other possible charges after leaving the main party.

b. Cancellation from Company:

The Company reserves the right to cancel any trip you booked unless guaranteed to run.

Naata Trek and Tours reserves the right to cancel any trip, including a guaranteed trip, prior to departure due to reasons beyond its control (i.e. due to natural disasters, flight cancellation, consequences of strikes, industrial action, wars, riots, sickness, quarantine, government intervention, weather conditions, or other untoward occurrences). In such cases, the company will refund the full trip price paid to the company. But the company should not be held responsible for any other trip related expenses such as booking of international flights, visa, insurance, vaccinations etc. Naata Trek and Tours Pvt Ltd is only liable for the payment made to the company.

5. MEDICAL CONDITIONS AND SPECIAL ARRANGEMENTS:

The Company must be notified in writing at the time of booking of any medical conditions, physically challenged conditions or any other mental and or physical condition which may affect fitness to travel and or any medical condition. Failure to notify the Company may result in the client being refused to travel. Failure to notify the Company of any such condition that results in cancellation will result in 100% cancellation fees to the Client.

Some trips may be unsuitable for Clients due to age, mobility, pregnancy or physical or mental conditions. It is the Client’s responsibility to check prior to booking. The Company is not liable to provide any special facilities unless it has agreed to do so in writing. The Company will do its best to meet Clients special requests including dietary, but such requests do not form part of the Contract and therefore the Company is not held liable for not providing these requests.

Traveler’s Note: Medical facilities vary from country to country and the Company makes no representations and gives no warranties in relation to the standard of such treatment.

6. TRAVEL INSURANCE:

The valid travel insurance is compulsory for all travelers. Your travel insurance must cover accidents, injury, illness and death medical expenses, including any related to pre-existing medical conditions, emergency repatriation (including helicopter rescue and air ambulance where applicable) and personal liability.

The company reserves the right to cancel or suspend your participation on a trip or in certain activities that is part of a trip, at any time, including after the commencement of your trip, with no liability of refund on its part, if you are unable to provide proof of insurance when requested.

Traveler’s Note: The Company also recommends it covers trip cancellation, curtailment and loss of luggage and personal effects. You must carry proof of insurance with you and produce it if reasonably requested by the company employees or suppliers.

7. FLIGHT DELAYS AND CHANGES IN THE ITINERARY:

Please note that mountain adventures are always unpredictable. Bad weather in mountain regions can cause domestic flight delays. In case of delayed domestic flights, the company will pay for departing city accommodation (Guest House) and food (Lunch & Breakfast) costs prior to your trip. However in case of delayed return flights, the client is responsible to bear all additional expenses including food and accommodation costs. If you wish to make an alternative arrangements such as Helicopter flight to avoid flight delays, all additional cost would be your responsibility.

Naata Trek and Tours does not accept any responsibility for costs incurred as a result of missed international flight, but would definitely assist to make alternative arrangements wherever possible. Please also note that while on the field, we may have to make some changes in the itinerary due to unforeseen circumstances.

8. TRIP AMENDMENT:

If the booking amendment request is received by the company 21 days or more prior to your original departure date then the company will make the necessary amendment with a charge of US$80 per person.

In case you wish to make amendments within 21 days of the trip departure, the cost of amendment may be higher depending upon the company’s arrangements with other parties such as hotels, Guest Houses, ground operators or airlines.

9. VISA & PASSPORT:

You must carry a valid passport and should have obtained the appropriate visas when traveling with Naata Trek and Tours Pvt Ltd. Please ensure your passport is valid for 6 months beyond the duration of the trip. Nepal Visa is available on arrival in Nepal. For Tibet & Bhutan, the company can make necessary arrangements upon request. For India, the client must acquire the Visa from their own home country.

It is your responsibility to ensure that you are in possession of the correct visas for the countries you are traveling to. The company does not accept any responsibility if you are refused entry to a country or places because of the incorrect visa documentation.

10.CHILDREN:

Persons under sixteen years old must be accompanied by a legal guardian or parent.

11. INJURIES AND EVACUATION:

Naata Trek and Tours Pvt Ltd. is not liable for any injury/health conditions/emotional or other conditions suffered by the client during the trip. Also our package cost does not include any personal insurance. Hence, we advise the clients to take adequate insurance packages. (Refer Clause 6)

12. SERVICES MISSED OR UNUSED:

There will be no discounts or monies refunded for missed or unused services, this includes voluntary or involuntary termination/departure from tour, i.e. sickness, death of a family member etc, late arrival on the tour, or premature departure either voluntarily or involuntarily.

13. COMPLAINT:

If you have any complaints regarding the trip, please let our staff know as soon as possible so that they can take the necessary steps to address them. Our first priority is making sure you are satisfied.

14. OTHERS

The Company is not responsible for any incidental expenses or consequential losses that the Client may have incurred as a result of the booking such as visas, vaccinations, non-refundable flights or rail, non refundable car parking or other fees, loss of earnings, or loss of enjoyment, etc.
